Bad Faith Litigation Team Secures Summary Judgment Decision in Multi-Million Dollar Fine Art Suit
The Ninth Circuit Court of Appeals recently affirmed a decision granting summary judgment in favor of a national insurance company in a multi-million dollar bad faith/breach of contract lawsuit. Plaintiff alleged his insurance company wrongfully denied his claim for the mysterious disappearances of a set of Keith Haring “Andy Mouse” silkscreen prints. A panel of Ninth Circuit judges unanimously sided with the insurance company and district court, finding Plaintiff had failed to produce evidence establishing ownership over the contested prints. This decision paves the way for the firm to begin collecting more than $250,000 in attorneys’ fees from Plaintiff – an alleged high net worth individual. The original summary judgment decision was obtained by Jonathan Yu and Robert Sullivan. Kelley Jancaitis, the firm’s appellate specialist, secured the decision on appeal.
