Our attorneys have experience in a wide variety of real estate litigation matters, and will use that experience for your benefit. We will investigate the facts and circumstances, and give you our opinion regarding the options available, and take the course of action that you select.

Contract Actions. If there is an issue under the purchase contract, whether before or after the closing, our attorneys will advise you on the various options available, and pursue relief through the courts to protect your interests. If the court rules in your favor, we will help you with the enforcement of that judgment.

Boundary and Easement Disputes. Sometimes there may be an encroachment across the property boundary line. Or there may be an interference with the rights granted under an easement agreement. Our attorneys will advise you on your rights, remedies or exposure under these circumstances.

Landlord/Tenant. If there is a default under a lease, and the parties are unable to resolve their differences outside of court, our attorneys will advise you on your rights and remedies under the lease agreement, and Arizona law in a forcible detainer action. If there is a dispute regarding how much is owed under a lease, our attorneys will advise you of your rights, duties, and responsibilities to protect your interest, and take appropriate action in the courtroom.

Judicial Foreclosure. If there is a default under the loan documents or a lien on the real property, our attorneys have experience in representing lenders, other lienholders and borrowers in court actions regarding lien enforcement, as well as possible defenses which may be raised.

Receiverships. Sometimes, appointing a third-party to take control of the management and operation of the real property is necessary. Our attorneys have experience in representing lenders (which seek to have a receiver appointed), borrowers (which owned the property that is the target of a receivership) and receivers (the person appointed by a court to operate and manage the property), and can advise you on your rights, duties and responsibilities in this type of legal proceeding.
